The following Terms of Service (“Terms” or “Agreement”) constitute a legal agreement between you or the entity or company that you represent (“Customer” or “You”) and BLUE-CODER.COM / ATHANASIOS TERZIS (“Blue-coder”), which governs Customer’s use of the Services and Products. The provided extensions/add-ons, can be accessed (a) as a free-to-the-user service having the specifications outlined in the respective Plan (the “Free Version”) and (b) as a paid service having the specifications outlined in the respective Plan, for which Customer pays a subscription fee (the “Paid Version”). Customer’s use of the Services and Products is subject to (a) the terms and conditions set forth below and (b) Blue-coder’s privacy policy, found at https://blue-coder.com/privacy and incorporated herein by reference, so please take the time to fully understand how these Terms and Blue-coder’s privacy policy govern Customer’s relationship with Blue-coder and Customer’s use of the Services and Products.
Customer acknowledges that the Free Version is provided at no charge, and therefore, the terms that govern use of the Free Version are different, in part, from the terms that govern use of the Paid Version. The specific provisions that relate only to the Paid Version are set forth in Sections 6 (Paid Version). All other non-specified terms shall apply to both the Paid Version and Free Version. If Customer upgrades from the Free Version to a Paid Version, Customer acknowledges and agrees that the terms that govern the use of the Paid Version shall automatically apply to Customer upon such upgrade.
CUSTOMER’S RIGHT TO USE THE PRODUCTS AND SERVICES IS EXPRESSLY CONDITIONED ON ACCEPTANCE OF THESE TERMS. BY CLICKING ON THE “ACCEPT” BUTTON AND/OR USING THE PRODUCTS AND SERVICES, YOU ARE UNCONDITIONALLY CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THE TERMS OF THIS AGREEMENT. IF YOU ARE ACCESSING THE PRODUCTS AND SERVICES ON BEHALF OF YOUR EMPLOYER OR ANOTHER ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE THE AUTHORITY TO AGREE TO THESE TERMS ON ITS BEHALF. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE PRODUCTS AND SERVICES.
1. Definitions
- “Content” means all text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features and other materials that may be viewed on, accessed through, or contributed to the Services.
- “Customer Content” means Content contributed to the Services by Customer.
- “Customer Data” means all Customer registration information and other transaction data collected, processed and retained by Blue-coder in connection with providing the Services.
- “Plan” means Blue-coder’s free or any paid plans, as applicable and as further described on Blue-coder’s website.
- “Services” means the services hosted by Blue-coder and provided to Customer under this Agreement.
- "Products" means any file distributed by Blue-coder and provided to Customer under this Agreement.
- “Systems” means modems, servers, software, network and communications equipment and ancillary services that are owned, controlled or procured by Customer.
- “Updates” means any patch, revision or update to the Products and Services delivered by Blue-coder.
2. Joomla name and logo usage
Blue-coder.com is not affiliated with or endorsed by The Joomla! Project™. Any products and services provided through this site are not supported or warrantied by The Joomla! Project or Open Source Matters, Inc. Use of the Joomla!® name, symbol, logo and related trademarks is permitted under a limited license granted by Open Source Matters, Inc.
3. Product Use
You may use each individual product on as many websites you want, under the terms of it's license.
4. Modifications
You are authorised to make any necessary modification(s) to our products to fit your purposes. The source code must retain the copyright notices and prominent notices about it's License.
5. Assignability
You may not sub-license, assign, or transfer your subscription to anyone else without prior written consent from Blue-coder.com.
6. Paid versions
6.1. Fees
Customer agrees to pay Blue-coder the fees, in the amounts and at the times specified in the selected Plan.
6.2. Payment Terms
The Plans are billed in advance on a monthly, biannual or annual basis, depending upon which payment plan is chosen by Customer. In case of service renewal before it's expiration, the time of the service will start counting after the expiration of the previous plan.
6.3. Return/Refund Policy
6.3.1. In compliance with European Union legislation, consumers residing in the EU are entitled to a statutory 14 calendar day "cool-off" period (right of withdrawal) from the date of purchase. If within these 14 calendar days you have not initiated the performance of the contract—explicitly, you have not started downloading any of our software and have not requested technical support—you are eligible for a full refund of your purchase, no questions asked. This right of withdrawal is provided in accordance with Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.
6.3.2. However, in accordance with Article 16(m) of Directive 2011/83/EU, the right of withdrawal and the right to a refund do not apply to the supply of digital content which is not supplied on a tangible medium if the performance has begun. Explicitly, when you give your prior express consent to begin the download of our software or initiate a support request, and acknowledge that you thereby lose your right of withdrawal, you waive your right to a refund. Under Article 14(4)(b) of the same Directive, once the downloading process has commenced or a support service has been initiated with your explicit acknowledgment, the subscription contract is considered executed and you are no longer eligible for a refund.
6.4. Files Accessibility
Once the Customer's payment is cleared, he/she will receive an email notifying the Customer that the subscription Plan was successful.
Signing in our site permits access to the appropriate download sections , in order to download the files related with the Customer's Plan.
Accessing Paid Products and Services requires an active Plan from the Customer.
6.5. Product Use
6.5.1. The Paid versions of our products will continue working, even after your Plan expires.
Though we do not guarantee any compatibility with the system over which they work (server, php, mysql, Joomla, etc.), in the future.
6.5.2. Access to updates for Paid version, requires an active Plan for the current product.
7. Warranty
Blue-coder.com does not warranty or guarantee these products in any manner. We cannot guarantee they will function with all 3rd party extensions or templates as there is currently no certification process for such extensions or templates.
THE SERVICES ARE PROVIDED AS-IS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF AVAILABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE AVAILABILITY, QUALITY AND PERFORMANCE OF OUR SERVICES IS WITH YOU. SHOULD ANY OF OUR SERVICES PROVE INEFFICIENT OR UNSUITABLE, YOU ASSUME THE COST OF ALL NECESSARY ACTIONS TO RECTIFY THE ISSUE.
8. Support
8.1. Our support aims to make our extensions functional, according to their specifications.
8.2. Support is only offered to our active subscribers through our ticket system under the following conditions:
- Tickets must exclusively concern the specific extensions covered by your active subscription(s).
- The most recent version of the extension must be installed and used.
- Our code remain completely unmodified.
- No third-party extensions or custom modifications may alter the functionalities provided by our extensions.
- Our extensions must be installed in an environment that meets the minimum technical requirements, as described in our documentation pages.
- Communications must be in English, expressed clearly and fluently.
8.3. Additionally, we reserve the right to refuse support, close tickets, or terminate services with the liability lying solely on the client under the following conditions:
- Abusive & Offending Language: The language used in the tickets, or any of its replies, includes abusive or contentious behavior, demeaning or profane language, harassment, bigotry, threats, or racial slurs. Such tickets will be unpublished or deleted immediately. While a warning may be issued at our discretion, any severe or repeated incidents will result in the immediate permanent termination of the offending user account and all active subscriptions without any refund, in accordance with our fair conduct policy.
- Feature Requests & Third-Party Integrations: The client requests a feature that does not exist or an integration with a third-party extension. While we appreciate client feedback and use it to guide future development, the creation of non-existent features cannot be provided within the scope of standard support. Repeated demands to provide such custom features for free will lead to immediate ticket closure.
- Third-Party Conflicts: The client requests a fix for an issue caused by a third-party extension or template. If an issue is traced back to third-party software, the client must address that software's developers for a fix. Our support team has the right to refuse any further assistance on that specific issue.
- Bad Faith & Refusal of Technical Analysis: The client does not accept our technical analysis without a meaningful or technically adequate counter-argument, declines to follow our technical advice in whole or in part, disputes our suitability to provide support, declines to provide information deemed necessary to perform troubleshooting, or declines to pursue the matter with their hosting provider or a third-party developer identified as the root cause. Such tickets will be closed without further reply and further support for that issue will be denied.
8.4. No Service Level Agreement (SLA): Requesting support does not guarantee a solution, and we provide no service level agreement whatsoever. While we make every reasonable effort to assist you, factors outside our control (such as limitations of the programming language, ISP/hosting restrictions, or core CMS limitations) may prevent a solution. In these cases, we will present our technical analysis and identify the root cause. At that point, the matter is considered resolved from our side. Any further action with third parties is entirely up to the client.
8.5. Providing us with direct access to servers, files, databases, or hosting processes is done entirely at the client's own risk and liability. We provide no warranties and assume no responsibility or liability for any damages, data loss, or downtime caused by our actions in such cases.
8.8. Technical support or development services for custom modifications and additional customizations outside the product specifications are not included in the standard subscription and will be charged extra.
Blue-coder.com reserves the right to change or modify the current Terms and Conditions with no prior notice.
